Mr. Müller mainly supports our competence area "Procurement and Tendering" in public procurement and public price law.
Due to his former long-standing activity in the Federal Ministry of Economics on the side of the legislator for public procurement as well as his long-standing membership in the German Procurement and Contract Committee for Construction Services (German: Deutscher Vergabe- und Vertragsausschuss für Bauleistungen, DVA), he is regarded as a proven expert in the entire field of public procurement.
Mr. Müller mainly deals with expert opinions and consultations for public contracting authorities and companies, above all on practical issues of public procurement in general and the procurement procedure in particular. He also conducts further education and training events on public procurement.
His main focus is on sectoral procurement law, i.e. drinking water supply, energy supply, provision of transport services, as well as on classical procurement law, among other things in the award of freelance services. A further focus is on questions of contract value estimation, but also on changes to contracts during the term of the contract that are not subject to public procurement law. The application of public procurement law in the case of grants is also part of his expertise.
In addition, Mr. Müller is an expert in questions of price law for public contracts. Here he is happy to provide advice, expert opinions as well as further training. The associated legal regulation PR No. 30/53 on prices for public contracts is binding for both public contracting authorities and companies when awarding contracts. He was in charge of this directive during his time at the Federal Ministry of Economics. Violations of the ordinance can lead to claims for compensation from the public procurement relationship as well as to proceedings for the imposition of fines.
Mr. Müller is author and editor of a commentary on sector procurement law ("Greb/Müller") as well as author and editor of the relevant standard commentary on price law ("Ebisch/Gottschalk/Hoffjan/Müller").
