Major projects in the field of energy transition, infrastructure, industrial and commercial settlements or residential construction are regularly associated with questions of state aid law, environmental law and energy law. Planning and approval procedures are often complex and require compliance with European and national regulations, as well as state and municipal provisions. It is often necessary to cooperate with planning offices, experts and external consultants.
In our competence team we advise and accompany you in complex projects with highly specialized lawyers and experienced practitioners of many years from the environmental administration as well as the municipal sector. Our team of legal advisors is supported by the renowned energy expert Prof. Dr. Karl Keilen. As head of the energy and climate protection department of a state environmental ministry for many years, Prof. Keilen was regularly entrusted with fundamental issues of energy policy as well as energy legislation (including energy industry law, renewable energy law, etc.). In cooperation with associations, municipalities and companies (especially in the energy industry), he has supervised numerous energy and climate protection projects in Rhineland-Palatinate. The current focus of his work is in particular the analysis of energy and climate protection legislation, consulting on the decarbonization of companies, on the development of emission-free mobility and on projects for the expansion of renewable energies.
In addition to "classic" energy supply companies, in particular in the form of municipal utilities, our clients include energy trading companies and energy producers as well as municipalities, private investors and companies that are active in the energy industry or intend to become involved in the sector.
In the field of environmental law, our "State and Administration" competence team provides comprehensive advice on all environmental aspects of building and planning law, immission control issues, and waste disposal law.
In the area of recycling management, we accompany legislative procedures (laws, ordinances, statutes, administrative regulations) and advise on the control of waste flows or the securing and development of landfills. Our attorney Prof. Dr. Gottfried Jung is your contact person for all questions concerning waste management law. Prof. Jung has been a member of the editorial advisory board of the leading legal review in Germany for waste menagement law "AbfallR - Zeitschrift für das Recht der Abfallwirtschaft" for many years and has many years of professional experience in leading positions in the environmental administration of the state of Rhineland-Palatinate and in the municipal sector.
The transaction experts of our competence group "M&A and Restructuring" render assistance on the acquisition as well as the sale of assets in the energy sector. We structure the acquisition or divestment process, conduct due diligence reviews and draft, review and negotiate the company purchase agreements (share or asset deal) for you.
Increasingly, questions also arise in connection with electricity tax refunds under the German Electricity Tax Act (StromStG), which are resolved for you by our "Taxes and Duties" competence team.
